State Laws Regarding Registration

Who must register?

In NJ, the Megan's Law sex offender registration and community notification provisions were signed into law on October 31, 1994 (chapters 128 and 133 of Public Laws of 1994 - These provisions are set forth in New Jersey law at N.J.S.A. 2C:7-1 through 2C:7-11

Are there special restrictions for registrants even after supervision?

In New Jersey, G.H. v. Twp. of Galloway, 401 N.J. Super. 392 (2008), the court found that [residency] restrictions created by municipalities were unconstitutional as they preempted the application of Megan’s Law.

Is there a process for removal from the registry? If so, who qualifies and what is the process?

Some registrants may petition. In each case, a motion must be filed in Superior Court with notice to the prosecutor. Prosecutor may object to removal. See section 2C:7-2, paragraphs f and g.

What is the registration requirement for someone with a sexual offense who is visiting the state?

No special statement for visitors

What is the registration requirement for someone with a sexual offense who will be moving to the state to live or to attend school?

Sex offenders convicted in another state are required to register within 10 days of moving to New Jersey. 2c:7-2 c.(1)
